Terms of service

Last updated

Effective date: November 2, 2026

1. Company and agreement

These Terms of Service govern access to https://instocktracker.com/, its product availability monitoring tools, and related notifications (together, the "Service"). The Service is operated by DK825, LLC, a limited liability company based in Illinois, United States ("we", "us" or "our"). Contact us at [email protected].

By accepting these Terms when you register or buy a pass, you agree to them. If you don't agree, don't register or buy. You must be at least 16 to use InStock Tracker. The Service is for users in the United States. You must have legal authority to make a purchase and to use the payment method you provide.

2. Scope of the Service

We provide tools that monitor retailers' product availability, currently in-store pickup at US Apple Stores, and send notifications based on preferences you choose. The pricing page and checkout describe the features, notification channels and limits included in each plan.

Your payment buys access to our monitoring and notification tools. It does not buy merchandise, a reservation, priority access at a store, or a guaranteed chance to buy. We don't control retailer inventory, checkout systems, order acceptance, delivery, warranties or returns. Purchases from retailers are governed by their own terms.

3. Independence and third-party names

We are an independent business and are not sponsored, authorized or endorsed by the retailers or manufacturers the Service refers to, including Apple Inc. Their names and trademarks belong to their owners and are used only to identify the products and stores covered.

4. Availability information and notifications

Stock information can become outdated between checks, and availability can differ by store, product configuration or customer eligibility. A notification doesn't mean an item is still available or that a retailer will accept an order. Confirm current details with the retailer before you buy or travel.

Monitoring and notifications can be interrupted by changes to retailer systems, access limits, maintenance, connectivity, device settings, spam filtering and notification providers. How often a store is checked is a target, not a promise. We don't promise uninterrupted monitoring, delivery of every notification, or a particular delivery time.

If no matching stock appears, you may get no alerts during a paid period even though monitoring works as described. If a supported retailer or a material feature becomes unavailable, we will tell affected pass holders and apply Section 8 where appropriate.

5. Accounts and acceptable use

You sign in with a one-time code sent to your email; there is no password. Give accurate account and contact information, keep your email account secure, and tell us about any suspected unauthorized access. You may use the Service for your own lawful purposes within your plan's limits.

You must not interfere with the Service, bypass security or usage limits, get unauthorized access, use it for fraud, create accounts or alerts in bulk, use several accounts to get around plan limits, or copy, resell or republish our data or content without permission. Automated access needs our written permission unless we provide an interface for it.

These Terms don't restrict anything applicable law allows you to do and doesn't let us restrict.

6. Plans and payments

Checking live stock is free and needs no account. Alerts need an account and a paid pass.

PlanPriceAlertsNotification channels
Free$0None (live stock search only)None
Plus$7.99 for 30 daysUp to 5Telegram, Discord, email, push
Pro$19.99 for 30 daysUp to 30All Plus channels, priority, and SMS once it launches

7. One-time passes and plan changes

Paid passes are one-time payments for 30 days. They never renew automatically, and we never charge you again unless you make another purchase. Buying the same plan again adds 30 days to your current pass. We email a reminder three days before a pass ends.

When a pass ends, your account returns to Free. Your saved alerts stay, but they stop sending until you buy another pass. A price change applies only to passes bought after it.

Cancelling before the first alert. Use the Cancel plan button on your plan in Pricing to cancel and automatically receive a prorated refund of the unused days, as long as no stock alert has been sent to you in the current paid period. The paid plan ends straight away and alerts stop; your alerts stay saved. See Section 8 and our Refund policy.

Plus to Pro. Unused Plus time is credited at the Plus price, and you pay the difference for a Pro pass that runs 30 days from the upgrade. If the credit is more than the Pro price, checkout charges Stripe's $0.50 minimum and turns the rest of the credit into extra Pro days. Checkout shows the charge and the new end date before you confirm.

Pro to Plus. Switching is always allowed, however many alerts have been sent. There is no charge and no cash refund for the switch. Unused Pro time becomes Plus time at the ratio of the plan prices; the new end date is shown before you confirm.

What counts as an alert. Refund eligibility depends on whether a stock alert was sent in the current paid period, not on whether it was received, opened or acted on. Test, billing, sign-in, security and other non-stock messages don't count. Deleting or pausing an alert doesn't change whether it was sent. My alerts shows every alert we sent and when. Contact [email protected] if you think a record is wrong.

8. Refunds

Until the first stock alert is sent in your current paid period, you can cancel with Cancel plan for an automatic prorated refund of the unused days: unused days × (price paid ÷ 30). For example, a $7.99 Plus pass with 20 days unused refunds about $5.33. Discounts are reflected in the price actually paid.

After at least one stock alert has been sent in the current paid period, that period isn't refundable under our ordinary cancellation policy, even if the alert was delayed, not received or not opened, the stock sold out, or you didn't buy the product. The pass runs until its end date unless it ends earlier under these Terms.

A Pro-to-Plus switch never produces a cash refund; the unused value becomes time. If an upgrade payment is refunded, the plan returns to Plus until the date the earlier Plus pass would have ended.

If you accidentally buy the same pass twice, contact us within seven days of the second payment for a full refund of the extra purchase. Refunds go back to the original card or wallet through Stripe and usually appear within 5 to 10 business days, depending on your bank.

We will correct billing errors and provide any refund or remedy required by law or by our express commitments. If we permanently discontinue the paid Service, or remove a material paid feature without a reasonably equivalent alternative, you may cancel for a proportionate refund of the affected unused time. These commitments apply regardless of the first-alert rule.

For help, email [email protected] from the address on your account. We usually reply within 1 to 2 business days. Nothing here removes consumer, withdrawal, refund or payment-dispute rights that can't be waived.

10. Privacy and communications

Our Privacy policy explains how we handle personal information, and our Cookie policy explains the cookie and browser storage we use.

Choosing an alert channel asks us to send alerts there. You can pause or manage alerts in My alerts. We don't send marketing messages. Turning off notifications doesn't cancel a pass or request a refund.

Text message (SMS) alerts are not available yet. When they launch, they will be part of Pro, up to 100 a month, and these rules will apply: by verifying your number and turning on SMS, you ask us to send automated stock alerts and verification codes to that number, never marketing. Frequency depends on restocks; message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to texts isn't a condition of any purchase. Carriers aren't responsible for delayed or undelivered messages.

11. Ownership and license

We and our licensors keep all rights in the Service's software, branding and original content. Subject to these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service while you're authorized to. Retailer data, product descriptions and third-party materials remain subject to their owners' rights.

You keep ownership of the information you submit. You allow us to use it to run and support the features you ask for, in line with our Privacy policy.

12. Suspension and termination

We may restrict access when reasonably necessary to deal with a security threat, fraud, a material breach of these Terms or a legal requirement. Where practical, we'll explain why and give you a reasonable chance to fix a breach that can be fixed.

You can stop using the Service at any time and use the cancellation and refund process in Sections 7 and 8. You can delete your account from your account menu; if you're eligible for a refund, use Cancel plan before deleting your account, because deleting it ends any remaining paid time. If we end paid access for reasons other than your material breach, we'll refund the unused paid time. If we end it for a material breach, refunds are subject to applicable law. Passes never renew automatically.

13. Warranty disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS AVAILABLE", WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DON'T WARRANT THAT MONITORING RESULTS WILL ALWAYS BE CURRENT OR THAT YOU WILL SUCCEED IN BUYING A PRODUCT.

This disclaimer doesn't exclude an express commitment we make, or a warranty or right that can't legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, we're not liable for indirect, incidental, special, consequential or punitive damages arising from use of the Service, including lost profits or lost opportunities.

Subject to the exceptions below, our total liability arising from the Service or these Terms won't exceed the greater of US $100 or the pass fees you paid us in the 12 months before the event giving rise to the claim.

These limits don't apply to our fraud, willful misconduct, gross negligence, or any liability the law doesn't let us exclude or limit. They don't reduce mandatory refund obligations or consumer remedies that can't be waived.

15. Changes to these Terms

We may revise these Terms for the future. We'll tell account holders about material changes by email or another clearly visible method at least 14 days before they take effect, unless a shorter period is needed for legal or urgent security reasons and the law allows it.

Changes don't affect a dispute that already exists. We'll get your agreement where the law requires it. If you reject a material change that affects a pass you've already paid for, you may cancel before it takes effect and ask for a proportionate refund of the affected unused time.

16. Governing law and disputes

These Terms are governed by Illinois law and applicable federal law, without applying conflict-of-law rules that would displace them. Mandatory consumer protections where you live still apply.

You can contact [email protected] to try to resolve a problem informally, but doing so isn't a condition of exercising your legal rights.

Unless the law allows or requires another forum, disputes may be brought in the state courts located in Illinois or a federal court with jurisdiction in Illinois. Nothing here prevents a qualifying small-claims action or requires a consumer to give up a forum the law protects.

These Terms don't impose mandatory arbitration or a class-action waiver.

17. General

If a provision is unenforceable, the rest still applies to the extent the law allows. Not enforcing a provision right away doesn't waive it. These Terms, our Privacy policy, Cookie policy and Refund policy are the whole agreement about the Service; mandatory law prevails over anything inconsistent with it.
